1. Acceptance of Terms
By accessing or using DCA Navigator (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including visitors, free-tier users, and paid subscribers.
2. Description of Service
DCA Navigator is a financial analytics platform that provides market data, charting tools, dollar-cost averaging simulators, and related analytical features ("Tools"). The Service is operated by Analytica Labz ("Company," "we," "us," or "our").
The Service is for informational and educational purposes only. Nothing on the platform constitutes investment advice, a recommendation to buy or sell any security, or professional financial guidance. See our Risk Disclaimer for full disclosure.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements.
4. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate and complete registration information.
- Maintain the security of your password and not share account credentials.
- Notify us immediately at support@dcanavigator.com of any unauthorized access.
- Take responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
5. Subscription and Billing
Paid subscriptions are billed on a monthly or annual basis through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions automatically renew unless cancelled before the renewal date.
- Cancellation: You may cancel at any time through your account settings. Access continues through the end of the paid billing period.
- Refunds: Payments are non-refundable except as required by applicable law or at our sole discretion.
- Founders Rate: Founders pricing is locked for the life of the account and follows you if you change plans. This rate is not transferable.
- Price Changes: We reserve the right to change pricing with 30 days' notice. Founders subscribers are exempt from price increases on their locked rate.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Reverse engineer, decompile, or extract the source code of any part of the Service.
- Scrape, harvest, or systematically download data from the Service.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
- Share, resell, or redistribute access to the Service without our written consent.
- Use the Service to provide financial advice to third parties as a professional service.
7. Intellectual Property
All content, software, trademarks, logos, and materials on the Service are the property of Analytica Labz or our licensors and are protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use.
8. Third-Party Data
Market data is sourced from third-party providers including Financial Modeling Prep (FMP). While we take reasonable steps to ensure data accuracy, we do not guarantee the completeness, timeliness, or accuracy of any financial data. Data may be delayed or contain errors. We are not responsible for decisions made based on this data.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANALYTICA LABZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Analytica Labz and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Modifications
We may update these Terms from time to time. We will notify users of material changes by email or prominent notice on the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.
13. Termination
We may suspend or terminate your access to the Service at any time with or without cause or notice. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
14. Governing Law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Monroe County, New York.
